Spirit and Groove Shipping Policies, Returns, Refunds, and Privacy Notice

Shipping Policies

Spirit and Groove, LLC charges different shipping and handling rates per our products. As of February 2017, these rates are:

 

T-shirts, Tanks, and Long-Sleeve Tees: 

  • United States: $4 for the first garment, $2 each additional item. 
  • Canada: $6 for the first garment, $2 each additional item.
  • UK: $8 for the first garment, $2 each additional item.
  • All other countries: $11 for the first garment, $2 each additional item. 

 

Drummer Hats and Drumming Headgear:

  • Shipped via USPS worldwide in a small box (to prevent damage to the caps). These rates vary depending on location and we offer various services depending on your destination. You can check the price from your cart after entering your address information. 

 

Delivery Estimates:

  • We apologize, but we do not have estimated times available to show before purchase. Visit https://www.usps.com/ship/mail-shipping-services.htm to learn more about estimated transit times. We WILL provide tracking information via email once your order is complete.

 

 Combination Orders:

  • If you order a combination of groovy drumming hats and shirts, they may be shipped separately and from different carriers.  Groovy hats are shipped via First-Class Package International Service, which is the most cost-efficient. We cannot expedite these orders at this time. We will provide separate tracking information when this happens. Contact us at info@spiritandgroove.com with any questions. We are happy to help. 

 

Expedited Orders:

  • If you choose an expedited shipping option. Please remember that the time it takes for us to pack and ship your order is not included in that timeframe.  We will send a tracking email once your order ships. We do our best to get all orders out as quickly as possible, but we could be practicing the drums and it may take a minute. :) 

 

SPECIAL NOTES ON INTERNATIONAL ORDERS:

  • Spirit and Groove tries our best to accommodate as many people who want to enjoy the groove with us as possible. However, international shipping can be tricky, so here are our policies. 
  • All orders and shipping charges are in US Dollars and your credit card company may charge additional fees to convert into the US Dollar.  Spirit and Groove, LLC is not responsible for those fees. Contact your banking institution to learn about your rates.
  • We have included a currency converter on our site. However, we cannot guarantee these rates.  Your financial institution will have the most accurate rates. Contact them for more details. 
  • Customs fees (taxes, duties, processing fees, brokerages fees, etc.) may be charged upon delivery and required to obtain your order. These fees are NOT included in your shipping charges and the customs agency or local government in your country may require you to pay additional fees to receive your items. Spirit and Groove does not include these fees and will not reimburse you for them.
  • We are not able to mark orders as "gifts".
  • We do not issue any refunds for customs fees, shipping, or the cost of your order should you refuse to pay the customs fees.
  • Spirit and Groove has no way of estimating customs fees, taxes, duties, etc. Please contact your local customs office if you need to know more.
  • By completing your order, you agree to pay all applicable fees. If your package is seized by Customs Officials for any reason whatsoever, we will not issue you a refund.
  • If you refuse or return your order no international shipping charges or fees paid to local government will be refunded.
  • If you have any questions, we encourage you to contact your Customs Office, as Spirit and Groove cannot advise you about your country's customs policies.
  • While many packages make it to their final destination without issues, Spirit and Groove is not responsible once the package lands in the destination country as we do not have any jurisdiction over international countries and their postal systems. Should any issues arise after the package has landed in the destination country, the recipient is responsible for contacting their local postal service to remedy the situation.
  • Payment times may take longer on International orders with Spirit and Groove.
  • Tracking information may not be available to your destination country.
  • Spirit and Groove reserves the right to deny any refund or return as well as the right to deduct applicable shipping and customs fees on international returns from the final refunded amount.
  • Service to your destination country may not be available at the time of your order. If this happens, one of our representatives will contact you to discuss your order.

 

Spirit and Groove, LLC Returns 

  • We make returns and exchanges groovy! If you are not 100% satisfied with your purchase, you can return the product and get a full refund or exchange the product for another one of similar price.
  • You can return a product for up to 30 days from the date you purchased it.
  • Any product you return must be in the same condition you received it and in the original packaging. Please keep the receipt.
  • Spirit and Groove, LLC reserves the right to decline any return or refund.

  • Also, please send an email to info@spiritandgroove.com letting us know your return intentions. 
  • You will be responsible for paying for your own shipping costs for returning your items. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
  • Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
  • If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

 

Refunds (if applicable)

  • Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
  • If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

 

Late or missing refunds (if applicable)

  • If you haven’t received a refund yet, first check your bank account again.
  • Then contact your credit card company, it may take some time before your refund is officially posted.
  • Next contact your bank. There is often some processing time before a refund is posted.
  • If you’ve done all of this and you still have not received your refund yet, please contact us at info@spiritandgroove.com.

 

Digital Downloads

Digital downloads are non-returnable and non-refundable.

Terms of Use:

Spirit and Groove, LLC hereby grants the purchaser, hereby known as the Licensee, the following uses.

  • Music downloads, tracks, samples, and beats: Licensee is granted worldwide, royalty-free, non sub-licensable, non-exclusive use of our materials to reproduce and share, in whole or in part, for perpetuity.
  • E-Books: Licensee is granted worldwide personal use for perpetuity and may not share, sell, barter, swap, or distribute the works without express written consent from the author and Spirit and Groove, LLC.

Licensee releases Spirit and Groove, LLC of any and all third-party claims or judgments resulting from the use of Spirit and Groove, LLC materials in whole or in part. In the event that Spirit and Groove, LLC is included in any such claims, the Licensee agrees to cover all costs including, but not limited to, legal fees, research costs, loss of consortium, and judgments.

 

Copyrights and Trademarks

All Spirit and Groove, LLC logos, trademarks, images, colors, and copyrights remain the property of Spirit and Groove, LLC and may not be used without written permission.

 

Privacy Statement  

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

 

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. 

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Links: When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Google analytics: Our store uses Google Analytics to help us learn about who visits our site and what pages are being looked at.

 

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. 

 

SECTION 7 - COOKIES

  •  Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not. 
  •  _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
  •  _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
  •  _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
  • cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
  •  _secure_session_id, unique token, sessional
  •  storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
  •  PREF, persistent for a very short period, Set by Google and tracks who visits the store and from where.
  • In addition, you may find cookies from, Google, MailChimp and other third-party developers we have partnered with. 

 

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
